Class action lawsuits occur when a large number of people, who have all been afflicted by the same problem, whether it be contracting an illness due to the negligence of another, becoming injured for a similar reason, or having been taken advantage of in some other way, seek monetary damages from negligent parties and/or those responsible for affliction to help cover the costs of any amounts that can directly be attributed to the negligent behavior.

Environmental class action lawsuits can occur when a company is responsible for a damage done to the environment, which in turn can affect the well-being of those people who are exposed to the environment on a regular basis. For instance, if a company buries dangerous chemicals underground, those chemicals can seep into the soil and ground water, affecting both plant life and water sources, which in turn can have adverse effects on the human body. Another example could be a company that exposes its employees to dangerous conditions within the workplace. Occurrences such as these typically take place when safety standards are not followed, or are laxly followed, and potential dangerous occur, such as when chemicals or solvents are inhaled into the body or absorbed by the skin, creating complications that can ultimately lead to an array of illnesses, including cancer.

In class action lawsuits, at least one person typically serves as the Lead Plaintiff in the case. This person, who is afflicted in some way him or herself, acts on behalf of all parties taking part in the lawsuit. Once the testimony of the Lead Plaintiff is heard, the court makes a ruling, and it is in this ruling that it is determined whether or not the accused negligence on the part of the defendant is substantial enough to warrant any sort of settlement. If a settlement is awarded to the plaintiffs, then the presiding judge decides whether or not the settlement is fair. Once the matter of fairness is agreed upon and/or edited to be deemed fair, the settlement is distributed, minus legal fees, amongst all those individuals who are involved in the class action lawsuit.
