Soil Contamination Attorneys

Soil Contamination

Soil contamination can affect a person's well being in multiple ways. If a person eats food that grows in contaminated soil, then that person runs the risk of ingesting the soil contaminant and becoming ill. If an animal is exposed to soil contaminate, and that animal ingests the contaminant, then that animal may become ill, even posing the possibility of passing the contaminant onto people who eat the animal. In any event, soil contamination, specifically contamination that results from the used of pesticides, herbicides, and underground storage leakage, can render an otherwise healthy person ill.

There are different ways in which soil can become contaminated:

  • Herbicides- chemicals that are used to prevent the growth of plants, such as weeds and other undesirable vegetation, that are poisonous, thus posing a health risk to anyone who ingests it
  • Insecticides- chemicals that are used to eliminate pests, specifically insects, that are poisonous and can cause illness if ingested by humans
  • Underground storage leakage- storage containers that typically house substances that are not necessarily good for the environment, such as gasoline, may become damaged or deteriorate over time, seeping toxic substances into the soil and ground water, thus creating a potential hazard for all those who come into contact with or use the contaminated ground water and soil

It is the responsibility of all those who use and house dangerous chemicals to ensure that the general public is not in anyway harmed by the dangerous product. If negligent parties choose to wantonly use pesticides and herbicides, not taking into account safety regulations and/or laws that may prohibit them from using a certain chemical, then that negligent party can be held liable for all damages that their negligence creates. Similarly, if a negligent party does not ensure that underground storage containers are properly maintained, then that party is responsible for all fallout associated with the improperly maintained and leaking container.
